Terms and Conditions of this site

Users of this site agree to be bound the following terms and conditions. If you do not agree with these conditions, please leave the site immediately.

• www.basement-picasso.co.uk and www.basement-picasso.com are hereinafter referred to as "the site"
• Peter B. Smith - trading as Basement Picasso is hereinafter referred to as "Basement Picasso"
• Users of the site that have an up to date subscription to the site are hereinafter referrred to as "Subscribers"
• People that have purchased anything from or through Basement-Picasso including subscribers are hereinafter referred to as "Purchasers"
• Information and/or images that are available under the Gallery tab section of the site, requiring an appropriate subscription to sell artwork, are hereinafter referred to as "Gallery Resources"
• Information and/or images that are available under the Studio tab section of the site, requiring an appropriate subscription to access, are hereinafter referred to as "Studio Resources"
• Information and/or images that are available under the School of Art tab section of the site, requiring an appropriate subscription to access, are hereinafter referred to as "School of Art Resources"

Copyright Issues

1) All material is copyright © 1994-2007 Basement Picasso, unless specifically stated, and all rights are reserved. No part of this site may be duplicated, replicated, copied, printed or transmitted (be it in electronic or physical media) without the express permission of Basement Picasso. Basement Picasso will pursue any breach of copyright to the full extent of the law.

2) Subscribers with access to the studio resources may use the reference pictures, including the virtual modeller images as follows:

2a) They may print images from the reference library for personal use, for the sole purpose of deriving original artwork. They may not distribute the images from the library in any form (electronic or physical), nor may they distribute a modified, altered or cropped version of the image.

2b) The user will own the full copyright for the original artwork which they have derived from the reference image. Basement Picasso would appreciate an acknowledgement in any public (including web based) exhibition of this original artwork. This reference should be of the form "based on material from www.basement-picasso.com".

3) Any person selling reference pictures, material or information to Basement Picasso will do so under the following terms:

3a) That person will retain full copyright © of all material provided, unless specificall agreed in writing prior to purchase.

3b) Basement Picasso will have unlimited, royalty free, use of the material which will include publishing on the site in any form, or publishing in any written article, document, magazine or book or similar, including electronic distributions. Basement Picasso may at Basement Picasso's discression, alter, modify, crop or edit or similar, any material, images or information, as is required for the purpose of publication.

Purchases

4) In all cases, all purchases are offered with a full 14 day "no question" guarantee. If the picture or print is damaged, or is not what you desired or expected, you may return the picture for a full refund including postage, or for full credit against an alternative picture.

5) Pictures that are purchased from Basement Picasso will be:

• Provided directly by Basement Picasso, if and only if the artwork has been created by Basement Picasso, otherwise
• The artwork will be provided indirectly by the third party artist as listed on the site.

Subscribers

6) Subscribers may subscribe to the Gallery resources to sell art, the studio resources to assist in creating art, and the school of art resources to learn to draw, paint and create art. Subscriptions may provide access to any combination of these resources at Basement Picasso's Discretion.

7) Basement Picasso reserves the right to add, modify, change, move or delete information as best meets the requirements of the site. Where this may substantively affect the material provided through a subscription, Basement Picasso may chose, at Basement Picasso's discretion to suspend a subscription type at any time, and will either provide a refund on a pro-rata basis, or a similar but superior subscription in its place at no extra charge.

8) Subscribers to the site, with an appropriate subscription, choosing to sell artwork must comply with the following

8a) All items offered for sale must be described accurately and completely.

8b) Any items that are sold outside of the site, or are otherwise no longer available for sale, must be removed immediately. Offering goods for sale through the site that are no longer available may result in your account with Basement Picasso being suspended or closed and/or may possibly incur civil or criminal penalties for fraudulent trading.

8c) Personal CV's, item descriptions, and other textual information should be accurate and complete.

Nudity

9) The site contains images including photographs, drawings and paintings of the naked human figure as would be seen in any typical Life Drawing studio. Drawings and paintings which have the naked human figure as a subject can be sold through the gallery pages of this site. Various parts of the site including some parts of the gallery, the studio and the school of art may present photographs of the naked human figure for the purpose of illustrating drawing and painting techniques, or to provide reference material to subscribers to allow them to make such drawings or paintings themselves.

9a) The site does not portray itself as an"adult", "pornographic" or "sexual" site, however, if artistic nudity is illegal in your region, or you are not of a suitable age to view such material, or you are of a sensitive disposition and wish not to view such material you can decline whilst still agreeing to the other terms and conditions of the site.

DECLINE ACCESS TO NUDITY or (Remove decision)

9b) You will not have access to photographic images of the nude figure until you specifically agree to these terms and conditions.

SPECIFICALLY ACCEPT ACCESS TO NUDITY

9c) All models used by Basement Picasso are 18 years old or older, without exception, and documented evidence is retained by Basement Picasso for all photographic material taken and provided on this site.

Offensive or inappropriate material

10) Basement Picasso reserves the right to unilaterally alter, edit or completely remove, without consultation or notification, any material which is deemed offensive, libelous, or discriminatory, including both images and text, irrespective of the original author or creator of such material. Further action, including suspending or closing an account may be taken.

10a) Artistic drawings, paintings and photographs of the naked figure are not considered inherently offensive.

Suspending or closing your account

11) If a subscriber fails to comply with the terms and conditions Basement Picasso reserves the right to suspend or close an account.

11a) If an account is suspended, all details will be maintained, however, the subscriber will not be able to login until the account is re-opened. To resolve the issue please contact support.

11b) If an account is closed, (either by Basement Picasso or at the subscribers request) all details will be permanently removed, including all images and all data pertaining to that user. The user will no longer be able to login.

VAT and Postage

12) All items sold through Basement Picasso are subject to Value Added Tax (V.A.T.) and Postage and Packing (P&P).

12a) Value Added Tax (V.A.T.) is charged at 17.5% before P&P is added.

12b) Postage and Packing (P&P) is charged after V.A.T. Multiple items may incur a reduced charge which will be shown in the paypal basket.

Customer care & confidentiality

13) Basement Picasso will not distribute customer information to any third party. Basement Picasso will only use customer details for the sole purpose of conducting a trade with that customer, or to allow the user to use the Basement Picasso site as intended.
